Divorce is the legal process to terminate your marriage or in other word to end the legal relationship that you entered through marriage. In England there is only one ground for divorce and that is that the marriage has broken down irretrievably. The marriage must be over one year to make an application for divorce at court.

The person who instigates the divorce proceedings is called the petitioner. It is for the petitioner to prove that the marriage has broken down irretrievably by relying on one of the five facts:

1. The other parties (referred as a respondent) committed adultery. The petitioner cannot rely on their own adultery. 2. The respondent has behaved unreasonably 3. The respondent has deserted the petitioner for at least 2 years 4. The parties (husband and wife) have lived separate for at least 2 years 5. The parties (husband and wife) have lived apart for 5 years
